Your consumer Rights

Applies to all JB Caravans purchases in Australia
Under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), every person who buys a caravan from JB Caravans is entitled to automatic consumer guarantees. These rights exist regardless of any warranty we offer, and cannot be excluded, restricted, or modified by contract.
Important: No JB Caravans warranty document, purchase agreement, or sales representation can take away or limit the consumer guarantee rights described on this page. Any term that purports to do so is void. If you believe your rights have not been honoured, please contact us — or contact the ACCC or your state consumer protection agency.
1. Your automatic consumer guarantees
When you purchase a caravan from JB Caravans, the following guarantees apply automatically by law (ACL ss 51–64A):

Acceptable quality
Your caravan must be safe, durable, free from defects, acceptable in appearance, and fit for all the purposes for which caravans are commonly supplied.
ACL s 55
Fit for disclosed purpose
If you told us a specific purpose you needed the caravan for and relied on our skill or judgement, the caravan must be reasonably fit for that purpose.
ACL s 56
Matches description
The caravan must match any description we gave you — including in our brochures, spec sheets, website, or during the sales process.
ACL s 57
Matches sample or demo
If you bought based on a display model, sample, or demonstration, your caravan must match that sample in quality and condition.
ACL s 58
Spare parts & repairs
We must take reasonable steps to ensure that spare parts and repair facilities are available for a reasonable period after purchase.
ACL s 59
Express warranties honoured
Any written or verbal promise, guarantee, or warranty we make about the caravan must be honoured — even if it goes beyond the statutory guarantee.
2. What you are entitled to if something goes wrong
Major failure
A failure is major if the caravan would not have been bought had you known about the problem, it is substantially unfit for its purpose and cannot easily be fixed, it is unsafe, or it is significantly different from the description. If there is a major failure, you are entitled to:
A full refund, or
A replacement of the same type and similar value, or
Compensation for the difference in value between what you paid and what you received
You may also seek compensation for any other reasonably foreseeable loss or damage caused by the failure.
Minor failure
If the failure is minor and can be remedied, JB Caravans is entitled to choose to repair the caravan within a reasonable time. If we do not repair it within a reasonable time, you may have the goods repaired elsewhere and claim the reasonable cost of repair from us.
3. What our warranty does not limit
These rights cannot be excluded, limited, or modified by any warranty document, terms of sale, or agreement.
Our JB Caravans factory warranty runs alongside your ACL consumer guarantee rights — it does not replace them. In some cases your ACL rights may provide a stronger remedy or a longer period of protection than our factory warranty. Both can apply simultaneously.
The following do not affect your consumer guarantee rights:
A "no refund" sign or policy at the point of sale
The expiry of our factory warranty period
A clause in any contract purporting to limit liability
The caravan having been used for its intended purpose
4. Exceptions and exclusions
Consumer guarantees do not apply if:
You caused the problem yourself through misuse, accident, or failure to follow the owner's manual
You used the caravan for an abnormal purpose outside its rated specifications
You were aware of the fault at the time of purchase and bought the caravan regardless
A third party (not JB Caravans or an authorised dealer) modified, repaired, or serviced the caravan in a way that caused the problem
Normal wear and tear and cosmetic damage caused by normal use are not covered under the consumer guarantee for acceptable quality. Damage caused by a failure to maintain the caravan in accordance with the service schedule, where that failure directly caused or materially contributed to the defect, is also not covered. Manufacturing defects that exist independently of any maintenance failure remain covered by your consumer guarantees.
5. How to make a consumer guarantee claim
Contact JB Caravans directly using the details in Section 6, or contact your authorised JB dealer
Describe the fault or failure clearly, including when it was first noticed
Provide proof of purchase (invoice, order number, or registration certificate)
We will assess your claim and respond within a reasonable time — typically within 10 business days
You do not need to accept a repair as your only remedy if the failure is major. You are entitled to choose your remedy for major failures.
